SELIING A PROPERTY
Before you market your residential property in New South Wales, it is compulsory under the current legislation to have a complete contract for sale and prescribed documents available.
We will order all necessary documents and searches as soon as possible after receiving your instructions. This ensures that the contract for the sale of your property is prepared without delay. The original contracts are kept on file and a copy of the contract is sent to your selling agent. Your agent can then take offers and advertise your property for sale. We will send you an account for the cost of disbursements and file preparation when we take your instructions. The balance of our fee is charged only when the completion of the sale has taken place.
When you have negotiated the sale price we will negotiate the contract with any prospective purchasers’ solicitors and forward an agreed contract for signature. We will work as fast as we can to secure your purchaser while ensuring your interests are protected.
We would expect exchange of contracts to take place shortly after issue of contracts, whereby the purchaser and you are bound to the contract.
Once an exchange of contracts has taken place Uther Webster & Evans will handle all necessary documentation to complete the sale on your behalf in accordance with your instructions. We will also respond to any requisitions the purchasers may make in relation to the title of the property. Finally, we will arrange settlement with any discharging mortgagee at no additional cost. There will be additional costs for other security properties not being sold)
Prior to settlement (completion of the sale – normally four to six weeks after exchange of contracts) we reach agreement with the purchasers on adjustments. Adjustments to the purchase price may be required for such things as Council or water rates. We will also take your instructions as to who will receive the balance of the purchase funds.
On the day of settlement we attend on your behalf, ensuring that all relevant documentation is handed to the purchaser and bank cheques are received on your behalf as per your instructions.
